A THUG who repeatedly assaulted a man with a glass jar during a family get together has been spared jail.

Ryan Burgun, pleaded guilty to assaulting the party member by repeatedly striking him on the head with the jar, punching and kicking him at The Greenside pub in Maybole on September 5, 2015.

He appeared before Sheriff Mhari MacTaggart at Ayr Sheriff Court with two other co-accused woman last Tuesday, May 10.

Linda McCrorie and Hayley McCrorie, of Manse Street, Maybole admitted behaving in a threatening manner, likely to cause fear or alarm by shouting, swearing and refusing to leave the premises when requested to do so.

The court heard from fiscal Mhairi Mair that: "On the night in question the witnesses were at the locus with the accused and family members. All parties were present when the complainer arrived.

"Linda McCrorie made her way to the back of the bar. But Burgun picked up a glass jar, which was witnesses, and struck his victim to the head who fell to the floor. Burgun was now shouting. He pushed and kicked him to the body.

"When the police arrived he was treated for a cut on his upper lip."

Defence Solicitor Steven Maxwell said: "Linda McCrorie appreciates her involvement and is thoroughly ashamed. She has accepted she acted in a disorderly manner. She accepts she shouted and swore and refused to leave the premises.

"She did not want to walk out of the public house at that time. There were visitors and they were having a family day. Alcohol had been consumed."

Speaking on behalf of Burgun, Mandy Stewart, said: "This was a day out. He does appear before the court with previous convictions and realises the position that places him in.

"He does have a stable relationship, a good job and is an exceptionally hard worker. He does have a background of consuming alcohol which is an area of concern which can be addressed with CPO. "

Defence solicitor John Gallagher said: "Hayley McCrorie is very anxious about this matter. She has accepted her involvement and has no other on going matters."

Sheriff MacTaggart addressed the dock: "In relation to the two woman, I am going to defer sentence for six months which means there will be no further offending.

"Mr Burgun you will accept you are in a different position. This is a serious matter. However I am taking into account the the report before me. I am prepared to step back from a custodial sentence."

Burgun, of Buckinghamshire, will complete a two CPO and 180 hours unpaid work within 12 months. He has also been ordered to pay £300 compensation to his victim in 28 days.

Sentence has been deferred for both Linda and Hayley McCrorie to be of good behaviour.
