A TIRED Ayr resident attacked a youth with a potato peeler who refused to keep the noise down.

Gary Smith, of Burns Statue Arcade,  admitted assaulting the young person, brandishing a potato peeler and repeatedly attempting to strike him with it - in February this year.

The 32-year-old appeared before Sheriff Desmond Leslie at Ayr Sheriff Court last year. The court heard how the incident took place around 10pm.

Depute Fiscal Kevin Jarvis said: "A group of friends were sitting on the steps. One of the girls was having an argument and woke the accused up from his sleep.

"He shouted out the window for the girls to be quiet. One person told the accused to f*ck off. Smith took a potato peeler to confront the group. He told them to be quiet and brandished the potato peeler.

"The complainer attempted to punch the accused but Smith made a lunging movement at his torso but was pushed away by the complainer.

"Smith said the police had been contacted and that they should leave. Police attended and observed a group of teenagers running away.

"The made inquiries and the accused stated that he had gone to his window with a potato peeler. This was seen on CCTV."

Addressing the dock, Sheriff Leslie, said: "In the future, remember what you are doing."

Smith was pardoned for his actions.
