A MAN refused to provide two specimens of breath after driving erratically near Prestwick.
Colin Mboyi, of Relugas Place, Edinburgh, failed to co-operated with the police when he was pulled over near to the Dutch House roundabout in October 2016, after he was suspected of have alcohol or drugs in his system.
The 24-year-old appeared before Sheriff Montgomery at Ayr Sheriff Court last week.
Procurator Fiscal, Mr Toal, said: “The accused was asked to provide two specimens of breath by the police but he refused to do so.”
Speaking on his behalf, defence solicitor Ms Cunninghame, said: “He had been drinking and he drove to Prestwick and he cannot exactly remember why he took the car to this area.
“Officers seen him driving erratically and he doesn’t have a strong memory of the occasion.
“He was taken to the police station in Saltcoats for a further breathalyser test."
Sheriff Montgomery ordered the accused to be disqualified from driving imminently and adjourned the court until May 31, for a Social Work report.
